Xavier Muñoz Bellvehí (Xavier.munoz@legallink.es).
The founding partner of Legal Link, Xavier advises on all areas covered by the firm including telecommunications regulatory law, investment in Spain and corporate transactions. He specialises in particular on matters relating to the Internet, mobile communications and broadcasting, including lotteries and gambling, premium rate communications, online music, etc.
After studying in Spain and the USA (junior year), he worked at leading law firms in Spain (Garrigues), Paris (DSParis) and London (Rakisons Solicitors - now Steptoe & Johnson). He is a lecturer at the LLM of ISDE Institute, speaks regularly at international technology conferences, and has published the book “Manual de Derecho de las Telecomunicaciones” and various articles. A congressional motion passed last December obliges the Spanish Government to draw up new national regulations covering online gambling, but in line with existing Spanish laws in a range of key areas. Xavier Muñoz of Legal Link looks at how Spain’s rigorous data protection legislation may be applied to internet gambling operators hoping to legitimize their presence in the Spanish market.
The Spanish Congress recently passed a motion obliging the Spanish Government to develop comprehensive, nationally-binding regulations covering remote gambling. But until the Government draws up those regulations according to principles outlined in the motion, current regional and national gaming laws will continue to apply to online gaming activities where the threat of prosecution exists.
