European Court of Justice Update: The Dutch Betting Cases White Paper

15 July 2010

Published by GamblingCompliance

‘European Court of Justice Update: The Dutch Betting Cases’, by GamblingCompliance's legal research team, addresses the key questions arising from the ECJ’s June 3 rulings on challenges to betting restrictions in the Netherlands.

The Dutch cases offered the first chance for the ECJ to further deliberate on cross-border internet gambling since its September 2009 ‘Santa Casa’ decision, which has already come to be seen as a landmark ruling in European case law on gambling.

GamblingCompliance’s white paper, available in one downloadable 36-page PDF report, analyses the ECJ’s Dutch decision, its possible consequences in the Netherlands, and also highlights further issues that are set to be addressed as the Court continues its scrutiny of market restrictions in other European countries.

‘European Court of Justice Update: The Dutch Betting Cases’ is the first in a series of GamblingCompliance reports spotlighting ECJ case law in the wake of the ‘Santa Casa’ ruling.

Further white papers, focusing on the ECJ’s decision involving Sweden last week as well as upcoming judgments related to Germany, will be published later this year.

For each case, GamblingCompliance attended oral proceedings at the European Court in Luxembourg.

The ‘European Court of Justice Update: The Dutch Betting Cases’ report:

Outlines the history of the Dutch proceedings
Highlights the arguments brought before the ECJ by parties including Ladbrokes, Betfair and the Dutch government
Evaluates the key issues involved, the rulings by the ECJ and subsequent reactions to them
Reviews the implications of the judgments in the Netherlands and at a wider European level
