However, Gibraltar's tax competiveness has been threaten by a European Commission's 2004 decision that suggested that for taxation purposes, Gibraltar should be considered part of the United Kingdom. In December 2008, Gibraltar obtained a major win as the EU Court of First Instance decided to annul the EC's decision.
