US Tribal Gaming And Revenue-Sharing Agreements

The Indian Gaming Regulatory Act makes it clear that states may not tax tribal gaming revenues. Yet, in the last 10 years, state governments have been able to impose questionable revenue-sharing agreements in order to authorise tribal gaming in their jurisdictions. Tax Specialists are inclined to consider that revenue-sharing agreements qualify as a ‘concealed’ form of taxation.
